PRIVACY POLICY FOR PERSONAL DATA  

Your privacy is important for us. Therefore, this Privacy Policy for Personal Data (hereinafter referred to as the “Privacy Policy”) has been developed for users of the website https://banzait.com/.  

The Privacy Policy applies to all information that the website located on the Internet under the domain name https://banzait.com/ (hereinafter referred to as the “Website”) may obtain about the User during the use of the Website, programs, and products of the Website Controller.  

  1. DEFINITIONS OF TERMS

    1.1. This Privacy Policy uses the following terms:  
    1.1.1. Controller – a legal entity registered as the owner of the Website, which determines the purposes and means of processing personal data and assumes primary responsibility for their processing. The Controller of personal data is the “data controller” under the terminology of Ukrainian legislation. Under this Policy, the Controller of personal data is: Limited Liability Company “TS Expertiza” (identification Code: 41165899, registered address: 03150, Ukraine, Kyiv, Antonovycha Street, 172).  
    1.1.2. Website Administration – authorized employees managing the Website on behalf of the Controller, who organize and/or perform the processing of personal data, determine the purposes of personal data processing, the scope of personal data to be processed, and the actions (operations) performed with the personal data. The Website Administration acts as the “data processor” under Ukrainian legislation and as the “processor” under GDPR. The Website Administration can be contacted via email at [email protected].  
    1.1.3. User – an individual who accesses the Website via the Internet and uses the Website, whose personal data is being processed. The Website User is the “personal data subject” under Ukrainian legislation and the “data subject” under GDPR.  
    1.1.4. Recipient – an individual or legal entity to whom personal data is disclosed, regardless of whether they are a Third Party.  
    1.1.5. Third Party – an individual or legal entity that is not the User, Controller, Website Administration, or a person directly authorized by the Controller or the Website Administration to process Personal Data.
    1.1.6. Personal Data – any information or combination of information about an individual who is identified or can be specifically identified.  
    1.1.7. Processing of Personal Data – any action (operation) or set of actions (operations) performed using automated means or without such means with Personal Data, including collection, registration, recording, systematization, accumulation, storage, adaptation, clarification (updating, modification), retrieval, use, distribution (provision, access, dissemination, transfer), anonymization, blocking, deletion, or destruction of Personal Data.  
    1.1.8. Confidentiality of Personal Data – an obligation for the Recipient to comply with the requirement not to disclose Personal Data without the consent of the User or the existence of another legal basis.  
    1.1.9. Profiling – a form of automated processing of Personal Data, consisting of using personal data to evaluate, analyze, or predict certain personal aspects of the User, such as their interests in the goods and services offered by the Controller.
    1.1.10. Cookies – text fragments of data sent by a web server that are stored on the User’s computer or mobile device while using the web server.
    1.1.11. IP Address – a unique network address of a node in a computer network that is assigned following the IP (Internet Protocol). 

  2. SUBJECT MATTER OF THE PRIVACY POLICY  

    2.1. This Privacy Policy applies to all Personal Data of the User that may be collected by the Controller during the User’s use of the Website.
    2.2. This Privacy Policy is designed to inform the User about the purposes and rules governing the use of the User’s Personal Data by the Website Administration, as well as the rights and obligations of the User and the Website Administration in relation to the use of Personal Data, and to guarantee the User’s right to the Сonfidentiality of their Personal Data.  
    2.3. By agreeing to the Privacy Policy, the User confirms that they have read and fully accept its provisions, their rights and guarantees, and the rights and obligations of the Controller, the Website Administration, and the Recipient concerning the issues governed by this Privacy Policy.  
    2.4. This Privacy Policy establishes the obligations of the Website Administration concerning the non-disclosure and safeguarding of the Сonfidentiality of the Personal Data provided by the User at the request of the Website Administration via informational electronic forms on the Website.  
    2.5. The Personal Data permitted for processing under this Privacy Policy is provided by the User through the completion of a feedback form on the Website and includes the following information: 
    2.5.1. The User’s last name, first name, and patronymic (if applicable); 
    2.5.2. The User’s country; 
    2.5.3. The User’s company name; 
    2.5.4. The User’s contact telephone number; 
    2.5.6. The User’s email address.  
    2.6. By completing the feedback form, the User consents to the processing of his or her Personal Data by the Controller. Such consent is given voluntarily and constitutes the User’s free and deliberate decision to provide or withhold such consent by choosing not to complete the feedback form on the Website.
    2.7. By granting Consent to the Processing of Personal Data, the User also consents to the transfer of such information to Recipients, regardless of whether they qualify as Third Parties, for the purpose of fulfilling the User’s requests related to the Controller’s goods and/or services, provided that such Recipients are directly or indirectly related to the goods and/or services in which the User is interested. In this case, the Recipient also assumes the obligation to ensure the Confidentiality of the User’s Personal Data in accordance with the terms of this Privacy Policy and/or the Recipient’s own Privacy Policy.  
    2.8. The User may, at any time, object to the Processing of their Personal Data by the Controller, revoke Consent for Processing, or grant Consent for Processing by sending a corresponding request to the Controller’s email address at [email protected]. Revocation of Consent does not affect the lawfulness of the Processing based on Consent prior to its withdrawal.  
    2.9. The Website Administration does not verify the accuracy of the Personal Data provided by the User, is unable to assess the User’s legal capacity, and operates on the assumption that the User is an adult, acts in good faith and prudently, provides accurate and sufficient Personal Data, does not infringe the rights of third parties, and makes every effort to keep such Personal Data up to date.  
    2.10. The Controller must notify the User of a Personal Data breach without undue delay if such a breach is likely to result in a high risk to the rights and freedoms of the User, enabling the User to take necessary precautionary measures. At the same time, the Controller must consider the legitimate interests of law enforcement authorities if premature disclosure could unduly complicate the investigation of the circumstances of the breach.
    2.11. This Privacy Policy is an internal document of the Controller and applies only to legal relationships between the Controller and the User arising from the User’s use of this Website. The Controller and/or the Website Administration are not responsible for ensuring the confidentiality of Personal Data on external websites that the User may access via links available on the Website’s pages.

  3. PURPOSES OF PROCESSING USER’S PERSONAL DATA  

    3.1. The User’s Personal Data may be used by the Website Administration for the following purposes:  
    3.1.1. Identification of the User to facilitate interaction with the Website Administration on matters related to the Controller’s activities; 
    3.1.2. Establishing feedback with the User, including sending messages and responding to inquiries related to the use of the Website, the provision of services, and the processing of requests and applications submitted by the User; 
    3.1.3. Providing the User with effective customer and technical support in the event of issues related to the use of the Website.  
    3.2. By granting Consent to the Processing of Personal Data, the User agrees to the use of such data for the purposes specified in Clause 3.1. of this Privacy Policy.  
    3.3. Additionally, the User may, by marking the appropriate checkbox in the electronic form on the Website, provide Consent to the Processing of their Personal Data for the following purposes:
    3.3.1. Profiling the User to determine their level of interest in the Controller’s products, preferences, and interests in the services and/or goods offered by the Controller, with the aim of developing the Controller’s network of products and providing effective solutions tailored to the User’s inquiries;
    3.3.2. Transmitting information about the Controller’s goods and/or services or information about the Controller directly to the User (direct marketing) using communication methods known to the Controller.  

  4. TERMS, METHODS, AND GUARANTEES FOR PROCESSING PERSONAL DATA
     
    4.1. The term of Processing the User’s Personal Data is determined based on the purposes of such Processing but shall not exceed the period established by the applicable laws of Ukraine.  
    4.2. The Processing of Personal Data is carried out by any lawful means, including within personal data information systems using automated tools or without the use of such tools.  
    4.3. The Website may use Cookies, which are small text fragments placed on the User’s computer or mobile device. The Website also uses pixel tags, web beacons, and other similar technologies to analyze web traffic, customize Website services, optimize user interfaces, and measure advertising effectiveness. Through these tools, the Website collects the following data: identification of active internet service providers, the User’s IP address, browser type, operating system, date and time of access to the resource, the referring website address (if any), and other similar traffic-related information.     4.4. The Controller and the Website Administration implement all necessary technical and organizational measures to ensure and demonstrate that the Processing of Personal Data complies with this Privacy Policy and the applicable laws of Ukraine. 
    4.5. The Controller guarantees that, by default, only those Personal Data of the User that are necessary for a specific purpose of Processing, as defined in this Privacy Policy, are processed.  
    4.6. The Website Administration employs all necessary organizational and technical measures to protect the User’s Personal Data from unauthorized or accidental access by third parties, destruction, alteration, blocking, copying, dissemination, and other unlawful actions by third parties.  
    4.7. To ensure security and prevent the use of Personal Data for purposes inconsistent with this Privacy Policy, the Controller and/or the Website Administration assess the risks inherent in Processing activities and implement measures to mitigate such risks, including encryption.  

  5. RIGHTS AND OBLIGATIONS OF THE PARTIES 
     
    5.1. The User has the right to: 
    5.1.1. Voluntarily provide and/or withhold Consent to the Processing of him or her Personal Data; 
    5.1.2. Obtain information from the Controller regarding whether him or her Personal Data is being processed and the content of such Personal Data;
    5.1.3. Submit complaints to the relevant supervisory authorities of the Controller’s country regarding compliance with the User’s Personal Data Privacy terms, if disputes cannot be resolved through negotiations with the Website Administration and/or the Controller; 
    5.1.4. Correct him or her inaccurate Personal Data by submitting a relevant request to the Controller’s email address at [email protected]
    5.1.5. Delete him or her Personal Data at any time at him or her own discretion, in accordance with the procedure established by Clause 2.8. of this Privacy Policy; 
    5.1.6. Restrict the Controller’s right to Process him or her Personal Data in cases established by applicable Ukrainian law by contacting the Controller via electronic communication; 
    5.1.7. Object to the Processing of him or her Personal Data in accordance with the procedure established by Clause 2.8. of this Privacy Policy; 
    5.1.8. Withdraw him or her Consent to the Processing of Personal Data in accordance with the procedure established by Clause 2.8. of this Privacy Policy.  
    5.2. The User is obligated to:  
    5.2.1. Provide only truthful and accurate information regarding him or her Personal Data; 
    5.2.2. Inform the Website Administration of updates to him or her Personal Data and the necessity for changes in the Website Administration’s databases.  
    5.3. The Website Administration has the right to:
    5.3.1. Consider the User’s Personal Data as accurate and, when necessary, update it.  
    5.4. The Website Administration is obligated to:  
    5.4.1. Process the User’s Personal Data in a lawful, fair, and transparent manner; 
    5.4.2. Provide information upon the User’s request about the fact of Processing him or her Personal Data and the composition of such Personal Data; 
    5.4.3. Provide any information upon the User’s request related to the application of this Privacy Policy and not covered herein, if the User’s right to request such information is justified and proven; 
    5.4.4. Use the information (including Personal Data) received from the User solely for the purposes defined in Section 3 of this Privacy Policy and not process such Personal Data in ways incompatible with those purposes; 
    5.4.5. Collect only the Personal Data from the User that is necessary for the purposes of Processing; 
    5.4.6. Store the User’s Personal Data in a form that allows identification of the User no longer than necessary for the purposes of Processing; 
    5.4.7. Process Personal Data in a way that ensures proper security, including protection against unauthorized and/or unlawful Processing and against accidental loss, destruction, or damage; 
    5.4.8. Ensure the confidentiality of Personal Data, not disclose it without the prior written consent of the User, nor sell, exchange, publish, or otherwise disclose the User’s Personal Data by any other means;
    5.4.9. Apply precautionary measures to protect the confidentiality of the User’s Personal Data in accordance with the standards typically used to protect such information in business practice and in compliance with applicable Ukrainian legislation; 
    5.4.10. Without undue delay, amend, erase, delete, or restrict the Processing of the User’s Personal Data upon receiving a relevant request from the User, him or her legal representative, an authorized data protection authority, and/or in other cases stipulated by applicable Ukrainian legislation.  

  6. LIABILITY OF THE PARTIES

    6.1. The Website Administration shall bear liability for damages caused to the User due to the unlawful use of him or her Personal Data as a result of non-fulfillment or improper fulfillment of its obligations under this Privacy Policy, in accordance with applicable Ukrainian legislation.  
    6.2. The Website Administration shall not be liable for Personal Data breaches if such breaches occur as a result of:  
    6.2.1. The Personal Data becoming publicly available before its loss or disclosure; 
    6.2.2. The Personal Data being obtained from a third party prior to its receipt by the Website Administration; 
    6.2.3. The Personal Data being disclosed with the User’s consent; 
    6.2.4. The Personal Data being provided to supervisory, executive, regulatory, or law enforcement authorities in accordance with applicable Ukrainian legislation.  
    6.3. The Parties shall be released from liability for non-fulfillment or improper fulfillment of the provisions of this Privacy Policy if the non-fulfilling Party proves that the violation occurred due to force majeure (acts of God or unforeseen circumstances). Force majeure events include natural disasters (fires, floods, landslides, etc.), military actions, earthquakes, hacker attacks, and other circumstances beyond the control of the Parties.  

  7. DISPUTE RESOLUTION 

    7.1. The Parties agree to resolve all disputes through negotiation.  
    7.2. If no agreement can be reached, the dispute shall be resolved in court in accordance with applicable Ukrainian legislation.

  8. ADDITIONAL CONDITIONS 

    8.1. The Website Administration reserves the right to amend this Privacy Policy without the User’s consent.  
    8.2. The new Privacy Policy shall come into force upon its publication on the Website unless otherwise specified by the new edition of the Privacy Policy.
